Waiver: I agree to hold the Dundee Scottish Festival, the Dundee Scottish Association, Sponsors, Black Rock Speedway, the Village of Dundee, and the Town of Starkey harmless for any loss or damage of personal property due to fire, accident, storm or any other cause. The Dundee Scottish Festival, the Dundee Scottish Association, Sponsors, Black Rock Speedway, the Village of Dundee, and the Town of Starkey shall not be liable to Contestant, agents, guests, family members or others for personal injury resulting in any way from activities conducted. Contestant expressly agrees to save indemnify and hold harmless the Dundee Scottish Festival, the Dundee Scottish Association, Sponsors, Black Rock Speedway, the Village of Dundee, and the Town of Starkey, its members, officers, directors, managers, agents, employees and volunteers from any damages, charges, liabilities, claims and causes of action whatsoever which result from any act or failure to act. The Dundee Scottish Festival, the Dundee Scottish Association, Sponsors, Black Rock Speedway, the Village of Dundee, and the Town of Starkey make no representations, warranties or guarantees of any kind with respect to results obtained by Contestant’s consequence of participation in the Dundee Scottish Festival and Highland Games. Fees are not refundable for any reason, including cancellation of the event due to weather conditions or other circumstances beyond our control.

I HAVE READ THIS AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW AND AGREE THAT IF ANY PORTION OF THE AGREEMENT IS HELD TO BE INVALID THE BALANCE, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

EXECUTION OF THIS DOCUMENT SIGNIFIES ACCEPTANCE OF AND ADHERENCE TO ALL GUIDELINES SET FORTH IN THIS CONTRACT APPLICATION.
