Participants of the Dundee Scottish Festival agree to the terms of this Waiver of Liability.

I agree to hold the Dundee Scottish Festival, the Dundee Scottish Association, VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey harmless for any loss or damage of personal property due to fire, accident, storm or any other cause. The Dundee Scottish Festival, the Dundee Scottish Association, VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey shall not be liable to the Participant, Participant’s Employees, Agents, Guests, Family Members or others for personal injury resulting in any way from activities conducted. Participant expressly agrees to save, indemnify and hold harmless the Dundee Scottish Festival, the Dundee Scottish Association, VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey, its Members, Officers, Directors, Managers, Agents, Employees and Volunteers for any damages, charges, liabilities, claims and causes of action whatsoever which result from any act or failure to act. The Dundee Scottish Festival, the Dundee Scottish Association, VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey make no representations, warranties or guarantees of any kind with respect to results obtained by Participant’s consequences of participation in the Dundee Scottish Festival. Fees are not refundable for any reason, including cancellation of the event due to weather conditions or other circumstances beyond our control.

I grant to the Dundee Scottish Festival, the Dundee Scottish Association , VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey , its representatives and employees the right to take photographs of me and my property in connection with the Dundee Scottish Festival. I authorize the Dundee Scottish Festival, the Dundee Scottish Association, VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey, its assigns and transferees to copyright, use and publish the same in print and/or electronically. I agree that the Dundee Scottish Festival, the Dundee Scottish Association, VFW Post #8649, Sponsors, the Village of Dundee, and the Town of Starkey may use such photographs of me with or without my name and for any lawful purpose, including for example such purposes as publicity, illustration, advertising, and web content.
